Nautilus Terms of Service
The Service is provided by NAUTILUS INTELLIGENCE LTD (“we”, “us” or “Company”). By using the Nautilus App, website, client, account or related services (the “Service”), you agree to these Terms and our Privacy Policy.
Service provider: NAUTILUS INTELLIGENCE LTD; Company number: 17131036; Registered office: 128 City Road, London, United Kingdom, EC1V 2NX.
1. The Service
Nautilus is a secure network connection service built on VPN (virtual private network) technology. It is intended to improve network privacy and security through encrypted connections, VPN locations and intelligent routing. The features, locations, device limits, data allowances and Plan restrictions are those shown in the App or on the purchase page.
A VPN does not guarantee absolute anonymity, uninterrupted connections, a particular speed, access to every website or streaming service, or the bypassing of third-party geo-restrictions or terms. Websites, apps, GPS, cookies, browser fingerprints and information you submit may still identify you.
2. Accounts and lawful use
You must be at least 18 years old, or the age of majority where you live if that is higher. You must provide accurate account information, protect your password and verification codes, and are responsible for activity under your account.
You may use the Service only lawfully. You must not use it for unauthorised access, hacking, fraud, spam, malware, denial-of-service attacks, infringement of intellectual property or privacy, distribution of unlawful material, mining, resale, or circumvention of Plan or security limits.
Local-law compliance. To the extent permitted by applicable law, you represent and warrant that, before using the Service, you will determine and comply with laws in your country, territory and place of network access concerning VPNs, encryption, internet access, content and data transfers. If local law prohibits or restricts VPN use or the Service, you must not use it or must immediately disconnect and exit. Using the Service does not mean that we have confirmed VPN use is lawful in your location, and you must not rely on us to make that legal assessment for you.
3. Plans, payment and auto-renewal
Prices, terms, taxes, features and renewal arrangements are shown before purchase.
- Purchases in the iOS App are auto-renewable subscriptions sold and billed by Apple through your Apple Account. They renew for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel them in iPhone Settings → Apple Account → Subscriptions.
- Purchases on our website are for the period shown and do not renew automatically unless the purchase page clearly says otherwise.
If a payment fails, is reversed or charged back, we may suspend the Service. Purchases through Apple or another third party are also subject to that provider’s payment, cancellation and refund rules.
Where required by applicable law, we will give notice of renewals, price changes and other material changes and provide a reasonably accessible way to cancel.
4. UK consumer cancellation and refunds
Nothing in this section limits rights that UK consumers have under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Rights Act 2015 or other mandatory consumer law.
You will generally have 14 days to cancel an online service contract from the day it is made. If you ask us to begin during that period, we may charge a proportionate amount for the Service supplied before cancellation. Where the legal conditions are met, the cancellation right may end after the Service has been fully performed.
For subscriptions bought in the iOS App, cancel in iPhone Settings → Apple Account → Subscriptions and request refunds from Apple at https://reportaproblem.apple.com. For website purchases, send a clear cancellation notice to support@nautilusai.co.uk. We will acknowledge the cancellation and process any refund within the period required by law.
Where the law requires us to provide a model cancellation form, we will make it available with the purchase confirmation or cancellation page. You do not have to use the form; a clear cancellation statement is sufficient.
5. Intellectual property
Subject to these Terms and, for paid features, an active Plan, we grant you a limited, non-exclusive, non-transferable and non-sublicensable licence to use the App and Service on compatible devices that you own or control. Rights in the App, website, brand, code, interface, content and documentation belong to us or our licensors. You must not copy, sell, reverse engineer, modify, resell or misuse them except where applicable law expressly permits it.
6. Availability, suspension and liability
We take reasonable steps to maintain the Service, but it may be interrupted or slow because of maintenance, networks, devices, third-party services, location capacity, security incidents or legal requirements. We may restrict, suspend or terminate the Service for a serious breach, unlawful use, payment failure or security risk, giving notice where reasonably practicable and legally permitted.
If we end a paid Service for reasons not caused by your breach, we will refund the unused prepaid period where required by law.
For UK consumers, we do not exclude or limit liability that cannot lawfully be excluded or limited, including death or personal injury caused by our negligence, fraud, fraudulent misrepresentation and statutory consumer rights. Unless the law says otherwise, we are not responsible for loss that was not reasonably foreseeable or was caused by your device, network or a third party.
7. Apps downloaded from the Apple App Store
If you downloaded the App from the Apple App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product-liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer-protection, privacy or similar claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any claim that the App or your use of it infringes a third party’s intellectual property rights.
- You represent that you are not located in a country subject to a UK, United States or other applicable government embargo, and that you are not listed on any government list of prohibited or restricted parties.
- You must comply with applicable third-party terms, such as your mobile network agreement, when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as a third-party beneficiary.
Questions, complaints or claims about the App should be sent to support@nautilusai.co.uk.
8. Privacy, changes and law
We process personal data as described in our Privacy Policy, which explains account, payment, technical and VPN-activity data, retention periods and your rights under UK data-protection law.
We may update these Terms because of legal, security, technical or Service changes. Where reasonably practicable, we will notify you of material changes through the App, website or email and state the effective date. Continued use after the effective date means you accept the update; mandatory consumer rights are unaffected.
These Terms are governed by the law of England and Wales. If you are a UK consumer, this does not remove mandatory protections or local-court rights available in Scotland or Northern Ireland; if you live outside the UK, it does not exclude non-waivable protections or court rights under the law where you live. Send complaints to complaints@nautilusai.co.uk; you may also seek a remedy from the relevant regulator or court.
